What Do You Think of Taxpayer-Funded Sex Changes for Inmates?

A federal judge's ruling Tuesday on a Massachusetts case is believed to be the first of its kind.

A convicted murderer will receive a state-funded sex-reassignment surgery because a federal judge has ruled it is the only way to treat her "serious medical need."

Massachusetts state prison officials must provide the surgery to Michelle Kosilek, who was convicted as Robert Kosilek for killing his wife in 1990. Kosilek was born a male but has received hormone treatments and lives in an all-male prison.

U.S. District Judge Mark Wolf is believed to be the first federal judge to order prison officials to provide sex-reassignment surgery for a transgender inmate, the Boston Globe reported.

Kosilek first sued the Massachusetts Department of Correction 12 years ago. Wolf ruled two years later that Kosilek was entitled to treatment for gender-identity disorder, but did not order surgery. The ruling earlier this week stems from Kosilek suing again in 2005. 

Sex change operations can cost up to $20,000. Many insurance companies reject the surgery as elective. 

In his decision, Wolf stated that the surgery is the ‘‘only adequate treatment’’ for Kosilek and that ‘‘there is no less intrusive means to correct the prolonged violation of Kosilek’s Eighth Amendment right to adequate medical care,’’ the Globe reported.

Prison officials have argued that allowing Kosilek to have the surgery would make her a target for sexual assaults by other inmates.

It is beyond absurd. The ignorance and stupity continues to grow like a weed and permeates society until we are all destroyed. Shortly I will sue the govt to pay for a hooker for me to satisfy my needs.

I am not a person that wants to punish prisoners any more than the law has stipulated. What bothers me is that in this case, the taxpayers are assigned the task of "fixing" his/her feelings about themselves based on an expensive ASSUMPTION that a change in gender can take care of the prisoner's emotional discomfort. The problem seems misplaced in my book: if I killed someone, unless I am a sociopath, chances are I would not be at ease in my own skin under the most perfect of conditions. In other words, perhaps it is the guilty conscience of this individual that causes the emotional heartache and not the assignment of gender. But we the taxpayers, cannot diddle around trying to guess what kind of physical makeover is going to make a prisoner feel better about themselves after they have committed a catastrophic crime. This is as outlandish as a female inmate demanding liposuction for her saddlebag thighs that has historically made her feel badly about herself. Puhleeze! Anyone living in reality knows that being at peace with themselves is an "inside" job, and no amount of exterior makeover is going to change how we feel about ourselves if we have done something rotten. Speaking of which, I wonder how much effort he/she has been made on addressing the murder and what actions have been taken to set things right with the family, society, etc. Again, it is not the taxpayers' work to guess what "fix" is going to make the prisoner feel better about their interior landscape.

how about a 1 shot cure, seen as he is a convicted killer anyway ,why don't we cure all his problems and we the taxpayer wont have to feed,house or babysit him/her any more

Would a hard working honest person with poor or no medical insurance be allowed the same benefits? I think not! This decision is absolutely disgusting and the individual/s who made it should be removed immediately. Excuse me while I go vomit....

I'm a liberal, but this is enough to make me a right winger. This person is a convicted murderer. We already pay for his/her food, lodging, television, exercise, supervision, whatever. Think of all the people who are NOT imprisoned for being a threat to society, and who don't have ANY food or ANY medical care! He/she appears able-bodied. Let him/her work to pay for a sex change after he/she gets out of prison.

Noooooo way !!!!! If medical insurances wont even cover that type of surgery how did tax payers get suckered into paying for it?? By far the stupidest thing Ive ever hurd..amazing inmates who need real medical treatment dont recieve it but mass is going to worry about this guy whos having trouble dealing with the fact he was born with a penis instead of a vagina..he must have a wonderful lawyer !!!!!

I'm a "liberal" socially, I guess one would say, and I'm not sure I agree with this, either. On the other hand, we weren't there, we don't know what doctors have said, we don't know the years of therapy this man has been through. How much does that cost??? I have faith that a judge wouldn't reach such a decision if there weren't a good reason. I think that this is one of those situations that falls out of the realm of any of our experiences and that we shouldn't judge based on ours.

I agree... as a convicted felon, this person has access to "medical" care far beyond what many law-abiding, working & productive, yet unfortunately uninsured or under-insured citizens do! In fact, even those who are lucky enough to have the benefit of health insurance, would most likely be on their own with this one. This ruling is not only bizarre, but unfair. Can someone please explain to me, what specific information this decision was ultimately based upon? Perhaps there is more to this story than meets the eye, and therefore some logical explanation that relies upon some hidden fact that I am missing??
